Let me give you an example. For instance two persons who are convicted of stealing one did it because he needs money for his kid's surgery but the other one had no need for money or at least didn't have enough reason. Now my question is that should we give them the same penalty or they should get diffrent punishments?

  • Dear Jeffrey, thanks for your comment. Your approach indeed is the best one because you didn't come up with the idea of punishing them first. you gave them the opportunity to compensate their mistake by helping others.
    for sure this could have more effect than putting them in prison. But as you said sometimes crimes are so complicated and therefore judging about criminals is so hard.

  •  I don't know how a judge to deal with this issue, but if I were the judge and law maker, first the money for the kid's surgery must be paid from the public funds and the father wouldn't be send to prison until the recovery of his child, but for the other thief I consider imprisonment and compensation immediately.

  • Dear Mishaikh, thanks for your comment. Actually I wanted t know what is your idea about it. Suppose that you a judge or law maker what would you do facing such condition?
  • There are different punishments in all criminal laws.  The first one committed the crime under extreme compulsion.  The judge consider it on the sympathetic (which is allowed in the law) basis.  I remember, I read some where, there was the punishment of amputation for a thieve,  but when the economical condition of the country got upset, the Khalifa, declare that there will be no punishment of amputation till every one of the citizen gets appropriate job to earn the living for his kids.

    So hope the matter is clear to you.
